1. Services offered

Through the Services, the User may connect accounts, upload data, and access AI-powered analytics, including but not limited to competitor tracking, performance metrics, and retention analysis ("Assets"). The Services are provided in accordance with the description, information and features provided on the Website or otherwise by Analytia, and may be modified, updated or deleted, in whole or in part, at any time.

Unless otherwise stated, any modification of the Services or any new Services offered by Analytia through the Website, shall be subject to these Terms.

To use the Services, the User must have access to the Internet and pay the costs arising from such access, as well as have the necessary equipment for this purpose. It is the sole responsibility of the User to verify, prior to contracting, the functionalities of the Services, as well as the suitability to meet their needs.

2. Registration

To contract the Services, you must register, creating an account on the Website ("Account") by signing in with your email account or authentication provider, as allowed by the Website from time to time. Important: the User must be of legal age.

The User undertakes to provide all mandatory information required for registration and acknowledges that such information is authentic, truthful, and up to date. Should false, outdated or incomplete information be provided, or should Analytia have reasons to suspect that registration is fraudulent, Analytia reserves the right to suspend or cancel the User’s Account.

By registering, the User undertakes to comply with the following rules:

• Third parties should not be allowed to access the User’s Account, nor should a third party’s Account be used.
• The User is solely responsible for actions taken from their Account. If you suspect that a third party is using your Account, you must immediately inform Analytia.
• Analytia may suspend or cancel the User’s Account if it considers that these Terms have been breached.

3. Use of the Services

The User agrees to use the Services only in accordance with these Terms and in good faith, and not to use the Services negligently or unlawfully.

Users must not:

• Interfere with or damage the Services.
• Attempt to reverse engineer or misuse the Services.
• Use bots, scrapers, or unauthorized tools to access or extract data from the Website.
• Upload, distribute, or use data that violates third-party intellectual property rights, privacy, or applicable laws.

Analytia acts only as a provider of technical tools and is not responsible for the legality or accuracy of data uploaded by Users.

4. Payments and Subscriptions

The Services are provided on a subscription basis ("Subscription"). Subscription terms, pricing, and limits are provided on the Website.

• Subscriptions auto-renew unless cancelled by the User.
• Payments are handled by third-party providers (e.g. Stripe). Analytia does not store card details.
• No refunds are provided except as required by law.
• If payment fails, Analytia may suspend or terminate access.

5. Intellectual Property

5.1. Analytia’s IP

All rights, title, and interest in the Website, Services, branding, software, and content remain the property of Analytia or its licensors.

5.2. User Data

Users retain ownership of their data but grant Analytia a license to process it solely to provide and improve the Services. Analytia will not sell or commercially exploit User data.

6. Liability

To the fullest extent permitted by law:

• Analytia is not liable for indirect or consequential damages.
• Analytia’s maximum liability is limited to the amount paid by the User in the preceding 12 months.
• The Services are provided "as is" without warranties of uninterrupted or error-free operation.

7. Termination

Analytia may suspend or terminate accounts that violate these Terms. Users may cancel their subscription at any time, effective at the end of the billing cycle.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Users submit to the jurisdiction of the courts of England and Wales, unless mandatory consumer protections apply otherwise.
